Terms and Conditions

1.    3rd Element Limited supplies goods on hire only on the following terms and conditions, no variation or addition to these conditions is effective unless it is agreed, in writing, by a Director of 3rd Element Limited.

2.    The Hirer shall prior to commencement of hire pay the full amount to 3rd Element Limited in the sum specified in the document of hire (for the period of the exhibition up to a maximum of one week (7 days) including Bank Holidays), as detailed on the hire contract. Account customers exempt. Cheques are made payable to 3rd Element Ltd.

3.    The period of hire shall commence at the time when delivery of each item comprised in the requisition is effected in the manner and to the person, destination or site indicated by the Hirer in the agreement.

4.    It is the duty of the Hirer to provide at such destination or site a duly authorised representative to accept the goods and to give a written receipt. If the Hirer fails to provide for this, he will not be permitted to dispute subsequently the facts of the delivery and these conditions.

5.    The Hirer undertakes to keep the hired goods in good order and condition and to return all of them to 3rd Element Limited in such order and condition. During the period of hire the Hirer is sole responsible for the hired goods and must insure against all risks.

6.    It is the duty of the Hirer to provide at the site of hire a duly authorised representative to sign a written confirmation of the items returned to 3rd Element Limited on termination of Hire. If the hirer fails to provide for this, he will not be permitted to dispute subsequently the facts of the delivery and be deemed to have accepted the delivery and these conditions.

7.    Hirers are reminded that all equipment should be emptied of personal belongings, at the conclusion of the event or exhibition as no responsibility can be accepted for their safe custody.

8.    3rd Element Limited will not be liable for a) Any delay or failure to deliver or collect due to circumstances which are outside its control, b) nor for any expense caused to the hirer by such delay, c) Loss or damage howsoever caused to customer's own goods.

9.    If the Hirer fails to return any goods, returns goods in a damaged or un-repairable state at the end of the agreed period of hire or within seven days from 3rd Element Limited making written demand, the Hirer hall pay to 3rd Element Limited the current replacement of the cost of the items, which have not been returned. Should payment in full not be received within 14 days from the date of invoice, the Hirer agrees to pay for all equipment loss, repair and cleaning. Hire charges will continue until full payment is made.

10.    3rd Element will not charge for transport for any Exhibitions we are committed to attending in the UK, delivery and collection costs are included in the hire charge. For any other Exhibitions/Events or Private hires transport charges will be applied based on 3rd Element Ltd’s current rates.

11.    For non-account customers, 100% of the agreed price must be forwarded with the hire's order, cheques made payable to 3rd Element Ltd.
 
12.    At the discretion of the Company, a charge of not less than 25% of the quoted hire charge may be made in respect of cancelled orders. If cancellation is made after the goods have been delivered to the site, the Company reserves the right to invoice the full hire charge.

13.    Any complaints that may arise must be submitted in writing during the open period of an exhibition/event. This will ensure that they are fully investigated on site.

14.    The prices shown in the price list are for the duration of an exhibition. Longer hire periods of an exhibition/event and any overseas exhibitions are negotiable. VAT is payable at the ruling rate on all charges at the date of invoice.

15.    3rd Element reserves the right to make substitutes without prior warning for furniture that may be unavailable. Any substitutes made will conform to the same standard of furniture.

16.    Interest maybe charged on any overdue invoices. Credit card payments will incur a 2% charge.
